Information Privacy Act or Right to Information Act?
The Right to Information Act provides a legal mechanism for people to access information held by council which is not provided administratively or via the publication scheme.
The Information Privacy Act enables individuals to access and amend their own personal information held by Council. An application under the Information Privacy Act may be made if you wish to:
- Access your personal information in council’s possession or under council’s control
- Amend your personal information in council’s possession or under council’s control
Personal information is described as “Information or an opinion, including information or an opinion forming part of a database, whether true or not, and whether recorded in material form or not, about an individual whose identity is apparent, or can reasonably ascertained from the information or opinion”.
The Right to Information Act provides a legal mechanism for people to access information held by council which is not provided administratively or via the publication scheme.
An application must be made on the approved form or alternately can be submitted in writing but must:
- Include sufficient information about the documents
- Sought so they can be identified;
- Provide an address where notices can be sent.
- Proof of identification (if an application under the Information Privacy Act)
Fees and charges
Right to Information: The application fee to access information under the Right to Information Application is $38.00.
There may also be process and access charges relating to your application dependent upon the time taken to process your application, the volume of documents you seek and where these documents are located. If your application is subject to these charges you will be notified and you will need to agree to pay these charges before accessing the documents.
Information Privacy Act: There is no fee to access or amend your own personal information under the Information Privacy Act application.
