Food businesses
It is a requirement that all food businesses in Queensland comply with all requirements of the Food Act 2006 and the Food Safety Standards 2001.
Queensland Health and Local Government are responsible for administering the requirements of the Food Act 2006 and Food Safety Standards 2001.
The aim of the Food Act 2006 is to ensure the safety of the public by the supply of safe and suitable food.
The Food Safety Standards sets out obligations for people who handle, sell, or prepare food for sale. All people who carry out these activities in a food business are responsible for ensuring the food that is sold is safe and suitable.
Food businesses are required to be licensed by council annually which requires food business owners to review licence information and pay an annual licence fee.

Footpath dining
Footpath dining is regulated by council's local laws. If you wish to utilise the footpath for dining purposes, an application must be made to council:

Once the approval is issued it is transferable. If you propose to take over an existing business that has footpath dining permit, the appropriate sections of the form listed above must be completed and submitted to council with the relevant fee.
